Austria | New teleworking law expands home office options in Austria
Summary
A new Teleworking Act is now to be introduced.
Changes to employment law
– A key amendment in Austrian employment law under Section 2h of the Labor Contract Law Amendment Act (AVRAG) updates the definition of home office to include both an employee’s primary and secondary residences, as well as those of close relatives and partners. The term ‘home office’ will transition to ‘teleworking’, which broadly encompasses regular work performed by employees using necessary information and communication technology, either at home or at locations other than the employer’s premises.
Changes to social security law
– Changes to statutory provisions on work accidents will differentiate between narrow and broad teleworking contexts. Narrow teleworking includes accidents at an employee’s home, relatives’ homes, or coworking spaces. Broad teleworking covers accidents at locations freely chosen by the employee outside the company’s premises.
